Beta Terms and Conditions
We refer to the Tyro General Terms and Conditions and Tyro Electronic Payments Facility Terms and Conditions at www.tyro.com (Terms) that govern (you, your) use of the Tyro Services. Capitalised words in these Terms and Conditions have the meaning given to them in the Terms unless specifically defined in these Terms and Conditions.
Background
These terms and conditions apply to your use of the DX6000 terminal (Tyro Health Pro Key EFTPOS machine(s)) as part of a beta test we are conducting (Beta) starting on the date you are confirmed as a participant and continuing for a period to 30 June 2025 or as otherwise agreed between the parties, or until terminated in accordance with these Terms (whichever is earlier) (Period). The Beta will be conducted at your nominated trading location.
The purpose of the Beta is to obtain your and your employees’ detailed feedback on:
- size, shape, convenience, portability and other physical specifications of the Tyro Health Pro Key EFTPOS machine(s);
- Tyro Health Pro Key EFTPOS machine(s) user experience for both your employees and customers in respect of the hardware and software;
- performance of the Tyro Health Pro Key EFTPOS machine(s) under your typical operating conditions, including battery life, connectivity and durability; and
- any other matters which we ask in relation to your use of and experience with the Tyro Health Pro Key EFTPOS machine(s),
(Feedback Areas).
Commercial terms
For the Period, you agree to the following terms.
- Use of EFTPOS machines
- The Tyro Health Pro Key EFTPOS machine constitutes an “EFTPOS Machine” (as defined in the Terms) and the provisions in the Terms that apply to “EFTPOS Machines” and “Equipment” apply to your use of the Tyro Health Pro EFTPOS machine(s) (subject to the terms stated on this webpage).
- You agree to use, and ensure that your employees use, the Tyro Health Pro Key EFTPOS machine(s) for all Transactions, except when you are not reasonably able to do so, in which case you may use your existing EFTPOS Machine(s).
- Fees
- No Equipment Fee will be charged in relation to the Tyro Health Pro Key EFTPOS machine(s) for the Period.
- Feedback
- You will use best efforts to ensure that employees provide you with regular and detailed feedback in relation to the Feedback Areas.
- In a post Beta survey, you will provide us with your and your employees’ detailed feedback in relation to the Feedback Areas.
- During the Period, you will contact us at 1300 01 8976 at any time in relation to any questions, concerns or issues you have with the Tyro Health Pro Key EFTPOS machine(s).
- Expiration, suspension and termination of the Beta
- At any time during the Period, we may, at our discretion, suspend the operation of the Tyro Health Pro Key EFTPOS machine(s).
- At any time during the Period, we may, at our discretion, terminate the Beta.
- Should you wish to terminate this Beta, you will provide us with a minimum of 5 business days’ notice.
- Towards the end of the Period, we will discuss your options with you in respect of which EFTPOS Machine(s) you choose to use after the Period. You will then return the relevant EFTPOS Machine(s) to us within 30 days at our cost.
- Warranties
- For the duration of the Period, the Tyro Health Pro Key EFTPOS machine(s) are provided on an “as is” basis and Tyro expressly disclaims any and all warranties, whether express or implied, to the maximum extent permitted by law.
By participating in the Beta, you acknowledge and agree to the terms detailed here.
You acknowledge that for use of this terminal, including but not limited to Medicare Easyclaim, private heath claiming, and EFTPOS terminal payments, you agree to the Terms. In addition, you acknowledge that this terminal requires services provided by Tyro Health Pty Limited, and as such, you agree to the Tyro Health Terms and Conditions.
